Welcome to SowGentle. Please read these terms and conditions carefully before using our services.

Agreement to Terms

By creating an account, clicking "Sign Up," or otherwise accessing the SowGentle application (the "Service") at app.sowgentle.com or our website sowgentle.com, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree to these terms, you may not use the Service.

Description of Service

SowGentle provides a mindful garden management platform including, but not limited to:

• Garden design and layout tools.
• AI-assisted plant library and sowing information.
• Garden task automation and reminders.
• Harvest tracking, financial ROI calculations, and journaling.
• Community-shared planting tips.

Account Registration

Eligibility: You must be at least 16 years of age to use this Service.

Data Accuracy: You agree to provide accurate email and identity information.

Sign-In: If you use Google Sign-In, you authorise us to access basic profile information to create your account.

Responsibility: You are responsible for maintaining the security of your account and password.

Age and Responsibility

You represent that you are 18 years of age or older or if under the age of 18 that you are using the Service with parental consent or consent of your guardian(s) or person acting in loco parentis (e.g. teacher) and that the terms of use of the Service have been brought to their attention and are accepted by them. If required by law you will provide us with any necessary references. You are responsible for anything you say or post. You understand that you are responsible for any use of the Service by you.

Subscriptions and Payments (The "Supporter" Tier)

SowGentle offers "Supporter" subscriptions (Monthly, Annual, and Lifetime).

• Merchant of Record: Payments are processed via Lemon Squeezy or Paddle. They are the legal Merchant of Record and their terms also apply to your financial transaction.
• Auto-Renewal: Monthly and Annual plans will automatically renew at the end of the billing period unless cancelled.
• Cancellation: You may cancel your subscription at any time through the "Billing" section in the App Settings. Your access will remain active until the end of the current paid period.
  

Refund Policy

• 14-Day Cooling-Off Period: In accordance with UK and EU consumer law, you have the right to cancel your subscription and request a full refund within 14 days of your initial purchase. This cooling-off period is applicable to all users.
• Requests: To request a refund, please email hello[at]sowgentle.com within the 14-day window. (Replace [at] with @)
• Exceptions: Refund requests made after 14 days will be considered at our sole discretion.

AI and Garden Information Disclaimer

• No Guarantees: SowGentle uses AI (including Google Gemini) to provide planting data and advice. While we strive for accuracy, gardening is subject to local weather, soil quality, and nature’s unpredictability.
• User Responsibility: All gardening information is provided for educational and inspirational purposes. We are not liable for any crop failure, property damage, or physical injury resulting from advice provided by the AI or our library.
• Planting Tips: Community-shared tips are the views of the users who post them and are not endorsed by SowGentle.

User Content and Conduct

• Ownership: You retain ownership of your journal entries and garden designs. By posting "Planting Tips," you grant SowGentle a non-exclusive license to display this content to the community.
• Prohibited Content: You may not post tips or usernames that are defamatory, offensive, or infringe on the intellectual property of others.
• Marketing: By signing up, you acknowledge that you may opt-in to marketing communications. You can opt-out at any time via the "Settings" menu in the app.

Intellectual Property

Unless otherwise stated, SowGentle and its licensors own the intellectual property rights for all material on the platform (software, design, brand). You may not reproduce, sell, or rent our proprietary code or design assets.

Limitation of Liability

To the maximum extent permitted by law (including UK Consumer Rights Act 2015), SowGentle shall not be liable for any indirect, incidental, or consequential damages resulting from your use of the Service. We do not exclude liability for death or personal injury caused by our negligence.

Termination

We reserve the right to suspend or terminate your account if you violate these terms. Upon termination, your right to use the Service will cease immediately.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Users in the EU and US also benefit from their local mandatory consumer protection laws.
